AGREEMENT TO TERMS

RETURNS AND REFUNDS

We stand behind our products with a 90-day, no-conditions return policy. If you are not satisfied for any reason, you may return your purchase for a full refund.

Refunds are processed within 5 business days of receiving your return and are issued to the original payment method. Please allow up to 10 additional business days for the funds to appear depending on your bank or card issuer. If you experience a delay, please reach out to us directly.

PROHIBITED ACTIVITIES

You may not use the Site to:

  • Engage in any unlawful activity or violate applicable laws or regulations.
  • Harass, abuse, threaten, or harm any person.

In all cases, our total liability to you shall not exceed the greater of $5,000 or the total amount you paid to us for the products giving rise to the claim.

GOVERNING LAW

⚠️ Confirm with Marc or your attorney before publishing: The governing jurisdiction is currently listed as Florida. Now that your registered address is in Lander, Wyoming, you should decide whether to update this to Wyoming. Do not publish until that decision is made.

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles. Any disputes not subject to arbitration shall be resolved exclusively in the state or federal courts located in Polk County, Florida.

DISPUTE RESOLUTION

Before initiating arbitration or litigation, both parties agree to attempt to resolve any dispute through informal good-faith negotiation for a period of 30 days following written notice of the dispute.

If a dispute cannot be resolved informally, it shall be settled through binding arbitration in Tampa, Florida, administered by the American Arbitration Association (AAA) under its then-current rules. The arbitrator's decision shall be final and binding.

Exceptions: Hem Healer® LLC retains the right to seek injunctive or other equitable relief in a court of competent jurisdiction to protect its intellectual property or confidential information without first engaging in arbitration.

MODIFICATIONS AND INTERRUPTIONS

We reserve the right to update, modify, or remove any content, features, pricing, or availability on the Site at any time without notice. We are not liable for any service disruptions, maintenance windows, or changes to the Site.
